3. Pre-sale order
Our customised lipsticks (“the Products”) are available online through our website. Each offered product is unique and made on demand by your personal order. These products are subject to return or exchange only according to our Happy Customer Guarantee under section 9.
At this stage, and until later this year (2020) we will only accept pre-orders. Our vision is to create personal and sustainable products. By pre-ordering our lipstick, you accept the risk that the order you have placed may experience changes, delays, and unforeseen challenges. We at Ellure thank you for your trust and support.
Once you have completed your pre-sale order, an order confirmation will be sent to your e-mail address. In the confirmation e-mail you will find all the details about your make-up products, along with the price, billing address and shipping address. If there is an error in the order confirmation, you should contact our customer service immediately.
You have to be at least 18 years old to customise and buy your own lipstick. If you are under the age of 18, parental written consent is required, as stipulated in the Swedish Children and Parents Code (SFS 1949:381).
The prices quoted, from time to time, apply to the website. Only exception is obvious misprints. Prices are quoted including value-added tax (VAT), unless otherwise specified.
The prices that apply to your Product will be stated in connection with your order.
Through the order, you undertake the responsibility to pay for the Product. For direct purchasing, the payment will be made directly upon purchase. Payment must be made through Swish. By using the Swish app and approving the payment via your BankID the payment is deducted directly from your bank account.
Payment may also be made through a valid gift card or promotion code issued by us (according to the terms and condition of the gift card or voucher under section 6).
We reserve the right to make a credit details report on you.
6. Gift card, voucher or discount codes
Gift cards or vouchers may only be redeemed toward the purchase of eligible goods and services provided by us and may not be used towards the purchase of another gift card or vouchers. Gift cards may not be reloaded, resold, or used for payment outside of our website; used for unauthorized advertising, lottery, or other promotional purposes. We are not responsible if your gift card or voucher is used without your permission. Title to and risk of loss for the gift card or voucher pass to the purchaser upon sale. Please treat your gift card or voucher with care and safeguard it accordingly.
Gift card and voucher expire within a given time period. In the event where a purchase gift card is not used within the given time period, we have no ability to refund the purchase.
Discount codes must be entered during the checkout process in order to be valid. Attempting to add a discount code after purchase will not be honoured. Unless otherwise stated, discount codes may not be applied to, or combined with, other campaigns or offers.
Delivery options are listed in the shopping cart upon choice of delivery. Please note that we only offer delivery to an address in Sweden. For delivery in Sweden we offer delivery through PostNord.
Expected delivery is October 30, 2020 when the product has been formally registered as a cosmetic product, however at the latest December 31, 2020. Please note that our product is under development, therefore we cannot give you any exact date for delivery, as for now. By entering into an agreement with us you accept the risk that the order you have placed may experience changes, delays, and unforeseen challenges. We at Ellure thank you for your trust and support.
If your package arrives damaged or opened, please notify your pickup point immediately when you retrieve the package. They have special forms for reporting damage. You have the ultimate responsibility for filing any claims with carriers for damaged or lost shipments.
8. Products and packaging
The product images and descriptions reflect the actual product as far as possible. However, it shall be noted that our descriptions of the products have not been reviewed by the Swedish Medical Products Agency. All ingredients in the product have been approved under the European Regulation on Cosmetic Products (EC 1233/2009), and as far as known free from unwanted effects. Please note, that this does not automatically mean that the product is flawless. It is of importance that the product is used in accordance with the instructions, precautions and guidelines provided with the product. Please make sure that the product does not contain anything you are allergic to.
Our mission is to make products that are as unique and wonderful as you. Therefore, we have made every effort to display the colours and images of the products as accurate as possible. However, we cannot guarantee that your computer monitor’s display of any colour will be accurate since the colours may look different in real life. Additionally, the actual colour of the lipstick may differ depending on the colour of your lips/skin. Neither, can we guarantee that our website is free of typographical errors. We do not warrant that the quality of any product, services or information will meet your expectations.
All products on our website, including samples, are intended for personal use only. Unless otherwise stated, we reserve the right to change the product we offer for sale or as part of a collection, without prior notice to you as a customer.
If your customised lipstick does not meet your standards, please let us know by sending an e-mail to es.erulle@olleh. We truly want to hear from you so we can make it better. We guarantee that every shipment is examined before it is sent to you. If the item is broken or incorrect when it arrives, you have a right to claim original errors from the day you receive the product. Refund for complaint will follow the refund policy in section 11. If a dispute cannot be resolved via contact with our customer service, you, as a customer, are entitled to contact the Swedish National Board for Consumer Complaints. 10. Happy customer guarantee
We offer a Happy Customer Guarantee to your first-time order, where we may offer you a free new lipstick if we accept your complaint. Your complaint must be made within a reasonable time (maximum 30 days from your package being received by you). Please note that our Happy Customer Guarantee applies to first time orders only. If you choose to exercise the Happy Customer Guarantee, we will be unable to refund the original purchase order. If you want to exersice this right, please send an email to es.erulle@olleh and we will handle your case as soon as possible.
Refund for complaint for non-first-time orders will follow the refund policy in section 11.
11. Right of withdrawal
According to the Swedish Distance and Off-Premises Contracts Act (SFS 2005:59), you as a consumer have a right to withdraw from a purchase within 14 days (“the withdrawal period”) from the day you received the product. However, you have no right of withdrawal if the product is specially made according to the consumers’ instructions or if the product has a clear personal touch. Since our products are made on demand customised by you, the colour of your lipstick is unique, purely personal and differs widely between customers. Therefore, the right of withdrawal does not apply to your purchase.
12. Refund policy
If you return a product to us by exercising your right in accordance with section 9, we will make a refund as soon as possible and no later than 30 days from the day we received your complaint. We reserve the right to investigate the product before giving you a written notice whether your complaint can be accepted and how we, in that case, remedy the error.
A remedy might be a re-delivery, price reduction or refund. A refund amount will include the price of the product, shipping costs, minus any value reduction. However, please note that you must at your own expense bear the shipping costs for returning the product to us.
We refund the money to you by using the same method you used when making your payment.
13. Limitations of liability
Our responsibility for the products, towards you as a consumer, is regulated by the Swedish Consumer Purchase Act (SFS 1990:932). Otherwise, our liability is limited to, breach of these terms and only for a total amount corresponding to the purchase product, unless there is gross negligence or intent. We assume no responsibility for indirect damages that may arise from the product. These restrictions do not apply to the extent that they would restrict your rights under the mandatory statute.
If fulfilment of our obligation is substantially hampered or blocked due to circumstances beyond our control (force majeure) we accept no liability for any delays or errors. Such circumstances are, amongst others, strike, fire, war, terrorist attack, act of God, pandemic, authoritative decisions, delivery restrictions or non-delivery from suppliers. These circumstances shall constitute grounds for exception which entail the advance of the time of performance and exemption from damages and other penalties. However, this should not limit your rights under the Consumer Purchase Act or other mandatory statute.

Our website may contain links to websites operated by one of our partners, advertisers, or other third party. Please note that the content of such websites or the products or services offered on them are not under our responsibility.

16. Intellectual property rights
The intellectual property rights to the website and all material published on the website are either owned by, or licensed to, us and is protected by copyright and reserved, unless expressly indicated otherwise.
For purely personal use, you may print a copy or download extracts of pages on our website. However, you are not allowed to use any part of the copyright material for commercial use or purposes without obtaining a license from us or our licensor at first.
If, at our request or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (“comments”), you give us an irrevocable right to quote from your comments regarding our products and services or us as a company that you submit on our website or social medium. These quotes may be used on our website, on social media and in our marketing.
